Terms and Conditions – Private sailing on the sailing yacht Tathagata
​
1. Scope
These terms and conditions apply to private sailing trips on the sailing boat Tathagata.
This is not commercial passenger transport, but a private invitation to participate in a joint leisure activity. Participation is as a private, joint sailing leisure activity.
There is no commercial charter or transport service.
Contributions to costs cover only a proportion of the on-board and travel expenses.

2. Description of services
The provider provides a place on board for the duration of the agreed period.
There is no travel contract and no package tour. The skipper provides the boat and navigation;
cooperation on board is expected.

3. Crew obligations
Sailors undertake to:
- follow the skipper's instructions
- assist with sailing and life on board as far as possible
- comply with safety and maritime regulations
- treat the boat and crew with respect
The skipper may exclude persons if they endanger safety.

4. Health & personal responsibility
Participants declare that they are in good health and able to take part in the trip.
Participants are responsible for bringing their own medication and equipment.

5. Liability
Sailing is at your own risk. The provider is only liable for intent and gross negligence.
No liability for:
- Injuries caused by sporting activities, life on board, or sea conditions
- Loss/damage to personal belongings
- Events caused by weather, authorities, or third parties
We recommend taking out international health/travel insurance and private accident insurance.

6. Weather, safety, route changes
The skipper decides on the route, ports, and anchorages. The route and schedule may be changed due to:
- Weather conditions
- Technical reasons
- Instructions from authorities
There is no entitlement to specific destinations or stages.

7. Cancellation & failure
Cancellation by participants is possible up to 30 days before the trip.
Later cancellation → reimbursement of reasonable costs already incurred.
If the trip does not take place due to force majeure, there is no entitlement to compensation.

8. Rules on board
Safety has priority
- No drug use
- Moderate alcohol consumption
- Respectful behavior towards crew and equipment

9. Legal jurisdiction & place of jurisdiction
The agreement is subject to private law.
In the event of a dispute, the law of the flag state of the boat or the current location shall apply.
